Introduction

The purpose of this Policy is to provide information, in accordance with the provisions of applicable legislation, on the processing that will be carried out concerning the personal data collected through the website http://eserp.com/ (hereinafter, “eserp.com”).

Access to and use of en.eserp.com and/or its subdomains confers on you the status of user (hereinafter “User/s”) and implies the knowledge and acceptance of all the conditions included in this Privacy Policy.

We are transparent about what we do with your personal data. So in order for you to understand the implications of how we use it or the rights you have in relation to your data, we permanently make all the information in this Privacy Policy available to you, which you can consult when you deem it appropriate.

  1. How do we collect personal data?

Users are hereby informed that as a result of the use of certain features of ESERP.com, it is necessary to provide certain personal data that will be incorporated into files of which ESERP is the data controller. Specifically, ESERP.com will record the following information:

    • Data from the contact form that the User who is interested in obtaining commercial information voluntarily provides to ESERP (name, surnames, email and telephone).
    • Data from the contact form at fairs that the User who is interested in obtaining commercial information voluntarily provides to ESERP (name, surnames, email and telephone).
    • Data from the form that the User who is interested in receiving information about news, offers, events and promotions voluntarily provides to ESERP (name, surnames, email and telephone).
    • Telephone contacts to the people interested in receiving commercial information who voluntarily call us or who we call to inform them that they will be recorded.
    • Data from the registration form for events and activities organised by ESERP.
    • Through the recording of online events, when attendees activate their camera and enable the recording of their image and, where appropriate, identification data.
    • Data from the form voluntarily provided to ESERP by the User who is interested in requesting information about an academic programme or applying to it (name, surnames, email and telephone).
    • Data from the form voluntarily provided to ESERP by the User is who interested in applying to be a student (name, surnames, email, position, company, telephone, programme and year).
    • Data from the form that the User in question voluntarily provides to contact and access ESERP’s selection processes in the “Work With Us” section (name, surnames, resume, email and telephone).

Remember that, when we ask you to fill in your personal data to give you access to a certain Website feature or service, we will mark some fields as required, as we need this data in order to be able to provide the service or give you access to the feature in question. Please note that if you decide not to provide us with this data, you may not be able to complete your registration as a client/user or you may not be able to use those services or features.

  1. For what purposes do we process your data?

In general, the information recorded through ESERP.com that ESERP obtains from Users will be processed:

    1. To process and respond to requests for information submitted by Users through the forms provided on ESERP.com, by email and/or telephone, as well as WhatsApp Business.
    2. To record communications and responses to requests for information made by users by telephone.
    3. To send information and other commercial communications, when so authorised by the User (invitations to Digital Talent Group events and information).
    4. To manage the enrolment process for ESERP academic programmes.
    5. To manage the enrolment and registration process for events and activities organised by ESERP. During the event, photographs and video recordings may be taken in which your image could be captured in an incidental manner and which may be published on all ESERP media, whether printed or digital, including Facebook, Twitter, Instagram, LinkedIn and YouTube accounts in order to promote the event.
    6. To record the online events and activities in which you participate (when you have voluntarily activated your camera) and to be able to share them with those who have not been able to attend.
    7. To manage the pre-registration process for students, alumni, teachers, experts and other professionals associated with our activity.
    8. To manage selection processes in which the User participates as a candidate.
    9. ESERP will carry out those actions to monitor and control the use of the website in order to prevent and detect any fraudulent use (such as technical manipulations, code modifications…), in order to avoid, prevent and/or detect any unauthorised access, alteration or loss of information related to third parties other than the user that may result in civil, criminal and/or administrative liabilities for ESERP.
  1. Are automated decisions made and is profiling carried out?

We inform you that there are no automated decisions, including profiling.

 

  1. To which recipients will we communicate your data?

ESERP may communicate user data to universities or other educational entities collaborating in educational programmes and that are expressly indicated in each case, who will use them for the stated purposes and in accordance with their respective privacy policies.

ESERP may communicate user data to Digital Talent Group companies for those cases in which information is requested on the programmes taught by said entities, who will use them for the stated purposes and in accordance with their respective privacy policies.

In addition, in order to fulfil the purposes indicated in this Privacy Policy, properly manage the service provided and the personal data of its users, ESERP will collaborate with third-party service providers who may have access to your personal data and who will process the aforementioned data in the name and on behalf of ESERP as a result of their provision of services. ESERP undertakes to sign the corresponding data processing agreement with them, through which it will impose, among others, the following obligations: apply the appropriate technical and organisational measures; process personal data for the agreed purposes and only according to ESERP’s documented instructions; and erase or return the data to ESERP once the provision of services has terminated.

 

  1. What is the legal basis for processing?

The legal basis for the processing of the data collected is:

    • We consider that we have your consent to attend to the requests or queries you submit to us through the various means of contact provided (forms, telephone, email), as well as to contact you and record the calls for quality reasons, informing you of said recording in the first call. We understand that the processing of this data is also beneficial for you insofar as it allows us to be able to attend to you properly and resolve any questions you have. When your inquiry is related to the exercise of the rights that we will inform you of below, or to claims related to our services, the legal basis for the processing of your data is our compliance with legal obligations.
    • When you contact us, in particular, about your application for admission related to your pre-enrolment/enrolment through ESERP.com, the processing is necessary for the execution of the contract/pre-contract.
    • The legal basis for the processing of your data for the purposes of sending communications about Digital Talent Group products, and signing up and registering for events and activities organised by ESERP, among others, is the consent you grant us, for example, when you agree to receive information through various means.
    • The legal basis for the processing of your data for the purpose of signing up and registering for events and activities organised by ESERP, as well as for recording the online events and activities in which you participate (when you have voluntarily activated your camera) is the consent you give us and/or the legitimate interest of the Company to record and take photographs.
    • The legal basis for the processing of the ESERP training programme accreditation survey is the contractual relationship with the student.
    • We consider that we have the candidate’s consent when they have sent us their application through ESERP.com or by sending an email to addresses that end in @ESERP.com.
    • We consider that we have the alumni’s consent when they have sent us their request to register as an ESERP Alumni.
    • ESERP’s legal basis is its legitimate interest in guaranteeing the security of its website, systems and information to process the data for the purpose of monitoring and controlling the use of the website.
  1. How long will we store your data for?

Personal data will be kept by ESERP only for the time necessary to achieve the purposes for which it was collected.

    • In the case of the contact form, request for information, admission application and/or fair form, it will be kept until the User revokes their consent.
    • In the case of requests for information through the sending of emails, it will be kept for the time necessary to correctly attend to your request.
    • In the case of commercial communications, registration for Digital Talent Group events and activities, it will be kept until the User revokes their consent.
    • In the case of commercial communications, registration for events and activities, it will be kept until the User revokes their consent.
    • During the validity of the pre-contractual/contractual relationship maintained with us and, once said relationship has terminated, during the limitation periods of the obligations arising from the processing of data.
    • In the case of a resume: until the User revokes their consent or one year from receipt.
    • In the case of “Work With Us”: until the User revokes their consent.
    • In the case of Alumni: until the User revokes their consent.

However, after said period has elapsed, the data may be blocked and kept by ESERP in order to manage possible liabilities arising from the processing, only until such liabilities become statute-barred. At the end of the aforementioned period, the personal data will be erased by ESERP.

The processing of data collected through cookies and similar technologies will be carried out in accordance with our Cookies Policy.

 

  1. What are your rights when you provide us with your data?

We are committed to respecting the confidentiality of your personal data and guaranteeing the exercise of your rights. At ESERP, you can exercise your rights at no cost by writing us an email to a single email address [email protected], simply indicating the reason for your request and the right you want to exercise. We may request a copy of a document proving your identity in the event that we believe it is necessary to identify you. The User may revoke the consent given for the processing of their data at any time.

In particular, regardless of the purpose or legal basis under which we process their data, the User may, at any time, request confirmation from ESERP as to whether their personal data is being processed by our Company and, if so, access it. Likewise, they may request that it be erased when, among other reasons, the data is no longer necessary for the purposes for which it was collected.

Likewise, in certain circumstances, the User may request the restriction of the processing of their data, in which case we will only keep it for the exercise or defence of claims. Also, you can object to the processing of your data in certain circumstances. ESERP will stop processing the data, except for compelling legitimate reasons or for the exercise or defence of possible claims. Finally, when appropriate, the User may exercise their right of portability to obtain the data in electronic format or to transfer the data to another entity.

In accordance with the provisions of current regulations, Users are hereby informed that it has proceeded to create a profile on the Social Network(s) Facebook, twitter, Instagram, LinkedIn and YouTube, with the main purpose of advertising its products and services.

The User has a profile on the same Social Network and has decided to join the page created by ESERP, thus showing interest in the information that is published on the Social Network. By joining our page, you give your consent for the processing of the personal data published on your profile.

The User can access the privacy policies of the Social Network itself at any time, as well as configure their profile to guarantee their privacy.

 

Purposes for which the data on social networks is used

The information and personal data provided voluntarily by the User through the ESERP profiles on social networks is processed for the purpose of:

  • Publishing information, advertising and the commercial promotion of ESERP products, services and activities on the social network.
  • Publishing information, advertising and the commercial promotion of the products, services and activities of third-party companies with which collaboration agreements have been reached on the social network.
  • Knowing the opinion and assessment of the User.
  • Accessing the profile’s public information.
  • Sending personal and individual messages through the Social Network’s channels.

 

Posts

Once a User has joined the ESERP page, they may post comments, links, images, photographs or any other type of multimedia content supported by the Social Network on the page, which is done by the User freely, voluntarily and consciously. In all cases, the User must be the owner thereof, hold the copyright and intellectual property rights or have the consent of the affected third parties.

It is expressly forbidden to post any text, graphics, photographs, videos, etc. on the website that violate or are likely to infringe upon morals, ethics, good taste or decorum, and/or that infringe, violate or breach intellectual or industrial property rights, the right to image or the law. In these cases, ESERP reserves the right to immediately remove the content and may request the User’s permanent blocking.

ESERP will not be responsible for the contents that a User has freely published.

Users must bear in mind that their publications will be known to other users, so they are primarily responsible for their privacy.

The User can always control their connections, eliminate content that no longer interests them and restrict who they share their connections with, to do which they must access their privacy settings.

The images that can be published on the page will not be stored in any file by ESERP, but they will remain on the Social Network.

 

Advertising

ESERP will use the Social Network to advertise its products and services. In any case, if it decides to use your contact details to carry out direct commercial prospecting actions, it will always be in compliance with the requirements of the applicable regulations.

Recommending the ESERP page to other users so that they can also enjoy the promotions or be informed of its activities will not be considered advertising.

 

Data protection rights

You can exercise your rights at any time, which are limited to the functionality of the social network, request that ESERP confirm whether your personal data is being processed by our Company and, if so, access it. Likewise, you can request the rectification of inaccurate data or, where appropriate, request its erasure when, among other reasons, the data is no longer necessary for the purposes for which it was collected.
